1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of VideoCompress (the "App"), a mobile application that provides video compression services. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and VideoCompress ("we," "us," or "our").
By using the App, you represent that you are at least 13 years of age. If you are under 18, you represent that you have obtained parental or guardian consent to use the App.
2. Description of Service
VideoCompress is a mobile application that enables users to compress video files locally on their device. The App provides:
- Video compression with adjustable quality settings
- Batch processing capabilities (for premium subscribers)
- Local thumbnail generation and video management
- Completely offline processing - no internet connection required
All video processing occurs locally on your device. We do not upload, store, or have access to your videos.
3. License and Restrictions
3.1 License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal device solely for your personal, non-commercial use.
3.2 Restrictions
You agree NOT to:
- Modify, reverse engineer, decompile, or disassemble the App
- Copy, distribute, or create derivative works of the App
- Remove, alter, or obscure any proprietary notices in the App
- Use the App for any illegal, harmful, or unauthorized purpose
- Attempt to gain unauthorized access to any part of the App
- Use the App to process content you do not have rights to
- Rent, lease, lend, sell, or sublicense the App
- Use the App in a manner that violates any applicable laws or regulations
4. Subscriptions and Payments
4.1 Premium Subscription
VideoCompress offers a premium subscription that unlocks additional features including unlimited video compression and batch processing. Subscription details:
- Subscriptions are billed through Apple's App Store
- Payment is charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel subscriptions in your App Store account settings
4.2 Free Trial
We may offer a free trial period. You will be charged when the trial period ends unless you cancel before the trial expires. We reserve the right to modify or discontinue free trials at any time.
4.3 Refunds
All purchases are processed through Apple's App Store and are subject to Apple's refund policy. We do not process refunds directly. To request a refund, please contact Apple Support.
4.4 Price Changes
We reserve the right to change subscription prices at any time. Price changes will apply to new subscriptions and renewals after a 30-day notice period.
5. User Content and Responsibility
5.1 Your Content
You retain all rights to the videos you process using the App. We do not claim any ownership rights to your content.
5.2 Your Responsibility
You are solely responsible for:
- Ensuring you have the legal right to compress and modify the videos you process
- Any content you create using the App
- Compliance with copyright, trademark, and other applicable laws
- The legality and appropriateness of the content you process
- Backing up your original files before compression
5.3 Prohibited Content
While we do not access your content, you agree not to use the App to process content that:
- Violates any applicable laws or regulations
- Infringes on intellectual property rights of others
- Contains illegal, harmful, or objectionable material
- You do not have permission to use or modify
6. Intellectual Property Rights
The App and all of its original content, features, and functionality are owned by VideoCompress and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
7. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that the App will meet your requirements or be uninterrupted, timely, secure, or error-free
- Warranties regarding the quality, accuracy, or reliability of any content or output
We do not warrant that defects will be corrected or that the App is free of viruses or other harmful components.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VIDEO COMPRESS BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, goodwill, or other intangible losses
- Damages resulting from your use or inability to use the App
- Unauthorized access to or alteration of your content
- Loss or corruption of your video files or data
Our total liability shall not exceed the amount you paid for the App subscription in the 12 months prior to the event giving rise to liability, or $100, whichever is less.
9. Indemnification
You agree to indemnify, defend, and hold harmless VideoCompress and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Any content you process using the App
10. Updates and Modifications
10.1 App Updates
We may release updates, patches, or new versions of the App from time to time. These updates may be necessary for continued use of the App. You agree to accept such updates and that these Terms will apply to all updates.
10.2 Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of the App at any time, with or without notice, and without liability to you.
11. Termination
11.1 By You
You may terminate your use of the App at any time by uninstalling it from your device and ceasing all use.
11.2 By Us
We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms or for any other reason at our sole discretion.
11.3 Effect of Termination
Upon termination, your right to use the App will cease immediately. All provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where VideoCompress operates, without regard to conflict of law principles.
12.2 Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through:
- First, informal negotiation with us by contacting support@videocompress.app
- If informal resolution fails, through binding arbitration or small claims court
You waive any right to participate in a class action lawsuit or class-wide arbitration.
13. Apple-Specific Terms
The following additional terms apply to your use of the App on iOS devices:
- These Terms are between you and VideoCompress only, not with Apple
- Apple has no obligation to provide maintenance or support services for the App
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation
- Apple is not responsible for addressing any claims by you or third parties relating to the App or your use of it
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce these Terms against you
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country
14. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our privacy practices.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Updating the "Last Updated" date
- Posting a notification in the App
- For significant changes, requiring you to accept the new Terms before continuing use
Your continued use of the App after changes constitutes acceptance of the modified Terms.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and VideoCompress regarding the use of the App and supersede all prior agreements and understandings.
